Terms of service

These terms are an agreement between you and ncdents, LLC (“SixWays”, “we”, “us”). They govern your use of sixways.ai, SixWays Cloud, and the commercial SixWays products and services we provide (together, the “Services”). If you use the Services for an organization, you accept these terms on its behalf and confirm you have authority to do so. If you have a signed order form or agreement with us, it takes precedence where it differs from these terms.

Open-source software

The SixWays Endpoint and other components we publish under an open-source licence are governed by that licence, such as Apache-2.0, not by these terms. Closed-source components we distribute free of charge, such as the eBPF enforcement sidecar, may be used under the licence that accompanies them.

Accounts

You are responsible for your account credentials and for activity under your account. Tell us promptly at security@sixways.ai if you believe your account has been compromised.

Subscriptions, trials, and fees

Paid plans are billed in advance for the period you choose, directly or through a cloud marketplace. Usage-based items, such as Cloud Sandbox capacity, are billed as described in your plan. Fees are non-refundable except where the law or your agreement says otherwise.

A Team trial lasts 14 days and needs no payment card. A trial ends on its end date and does not turn into a paid subscription automatically. To keep using Team after the trial ends, you need a paid subscription.

Licence grace and lapse

If a subscription payment fails or a subscription ends, paid features continue through a grace window of 14 days. After grace ends, or immediately if we revoke a licence, paid governance and management features stop. The process sandbox and eBPF enforcement keep enforcing until your administrator changes the policy, and administrators can always revoke access, deny approvals, stop sessions, and tighten policy.

Your data

You keep all rights to the data you put into the Services. You give us permission to process it only to provide, secure, and support the Services, as described in our privacy policy.

Acceptable use

You will not use the Services to break the law, to attack or probe systems you are not authorized to test, to interfere with the Services or other customers, or to reverse engineer closed-source components except where the law allows. Security research on SixWays itself is welcome under our disclosure process.

Availability and support

We provide support and any uptime commitments as described in your plan or agreement.

Warranties

Except as stated in your agreement, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. No security product can prevent every attack.

Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Each party’s total liability under these terms is limited to the fees you paid us for the Services in the 12 months before the claim.

Termination

You may stop using the Services at any time. We may suspend or end access if you materially breach these terms and do not cure the breach after notice. Sections that by their nature should survive termination will survive.

Changes

We may update these terms. We will post changes on this page and, for significant changes, notify account holders before they take effect.

Governing law

These terms are governed by the laws of [jurisdiction to be confirmed by counsel].
